Texas, A One Bite State

Unlike most states, Texas has no specific statute to describe a dog owner’s liability when their dog attacks someone. In a 1974 case, though, called Marshall v. Ranne, the Texas Supreme Court ruled that the state shall follow a “one bite rule” in regard to personal injury liability. The “one bite rule” states that a dog’s first bite is “free”. After the first bite, though, the owner of the dog is then on notice of their dog’s tendency to bite. In other words, a dog that has bitten in the past is known to have a tendency to bite and their owner will be considered negligent if they fail to prevent any future bites.

In Texas, it typically must be shown that:

  1. The dog owner knew that the dog was aggressive or had bitten in the past, and/or
  2. The dog owner negligently failed to use reasonable care to control their dog or prevent injury and
  3. Injury occurred as a result of the bite/attack.
